THE COUNCIL OF THE CITY OF NEW ORLEANS, LOUISIANA
GLOBAL RATE SETTLEMENT DOCKET UD-08-03
The Council of the City of New Orleans ("Council") serves as the regulator of the rates, terms and charges of Entergy New Orleans, Inc. ("ENO")
and Entergy Louisiana, LLC ("ELL") in the provision of gas and electric service in Orleans' Parish. Members of the Firm have represented the
Council since 1982 in all facets of its exercise of primary jurisdiction in the regulation of these two entities. Most recently Members of
the Firm served as the chief technical consultant in the Council's instant docket UD-08-03 dealing with a request for a change in rates for
gas and electric service in New Orleans. In the conduct of this assignment, Members of the Firm sponsored direct and redirect testimony in
Council Docket UD-08-03 on rate of return, rate design, cost of service, revenue requirements, complex tax issues, and the funding of demand
side management programs ("DSM"). As the chief architect in the development and finalization of a global rate settlement between ENO, industrial
customers, consumer groups and the Council, Members of the Firm effectuated a settlement in the Docket that resulted in a $35,259,000 reduction
in electric rates and a modest $4,950,000 increase in gas rates in the jurisdiction. In addition, the settlement provided for the implementation
of a financial hedging swap program for the use of natural gas as a generating fuel during the summer of 2009, reconciliation and amortization
of the costs incurred by ENO in Hurricanes Gustav and Ike in 2008, implementation of a new fuel adjustment clause, the participation by ENO in a
new 100 megawatts of highly efficient natural gas generation in a transmission constrained load pocket area, the complete redesign of customer bills
for ease of understanding, and the implementation of a funding mechanism and process for the accelerated implementation of energy conservation and
demand side management measures in Orleans Parish in 2009.
CITY
OF BURLINGTON, COLORADO RESOURCE PROCUREMENT SUPPORT
The City of Burlington, Colorado
operates a municipal electric system. ERG was retained by the City to develop and
manage a Request For Proposals (“RFP”) for acquisition of long term wholesale full requirements
power supply resources to meet the needs of the City’s municipal electric system. Specifically,
ERG was responsible for preparation of an RFP, management of pre-bid meetings, issuance of
the RFP, evaluation of bids, and recommendation of award. In addition, members of ERG played
a key role in negotiating purchase power agreements on behalf of the City. In conjunction with
this engagement, members of ERG coordinated with City management to determine the City’s interest
in opting-in to the provisions of Colorado’s renewable energy standards requirements as established in CRS 40-2-124.
